Good morning. This is your insurance connection. I'm your host, Donald Marquez, on your insurance connection. We talk about saving money on auto insurance, homeowners insurance. Yes. And we talk about life insurance. Welcome to the show. Good morning. This is Dan Marquez with your insurance connection. Happy Sunday morning. Right here in Las Vegas, Nevada. Broadcasting from KU envy 91.5 Jazz and more. My name is Don Marquez. This is your insurance connection. today. I have with me Christine Barnard. Good morning, Christina. Morning.

Unknown Speaker 1:00
Don, how are you?

Unknown Speaker 1:01
I'm fantastic. You know enjoying this beautiful weather we have here in Las Vegas, Nevada. I love the overcast. I love the rainy days. I love the cool because you know summertime when when the dial is turned up is real, real hot in Vegas. And absolutely

Unknown Speaker 1:15
we need to enjoy it while we can yes,

Unknown Speaker 1:17
we should enjoy this while we can get out take a walk you know,

Unknown Speaker 1:21
get some fresh air get some fresh air. I agree with you.

Unknown Speaker 1:24
So Chrissy and joining me today because she is a person that helps me with my clients when they receive a speeding ticket. In most cases, you can get reduced down to a parking ticket.

Unknown Speaker 1:36
Yes, we have someone that takes care of all of our traffic issues, speeding tickets. And even if you get something a little more than a speeding ticket, I suggest that you call me. And I'll give you the attorneys number that handles those tickets before you pay the fine. It's important that we take care of this prior to payment. And

Unknown Speaker 1:57
it's really important because I've talked to people that they've paid the fine already through the court systems and the court systems tell them, they reduced down the speeding ticket down to a parking ticket. However, as an insurance agent, when I run their driving history, I see that speeding ticket sometimes they think I even put that speeding ticket in there, the date they got the speeding ticket now how would I know that information and you don't have access to that information? I don't know where it comes up on their record. But they do go to the courts. And they say the courts tell them because they paid it. And I guess they paid a little extra whatever it is they paid a little extra. And they said well, the courts Tell them we'll reduce it down to a parking ticket. But that doesn't happen. What is the next step for them to get it reduced? Well,

Unknown Speaker 2:39
the next step is I need to get an attorney someone to go through the system and get that action reversed. Because what happens most times it's not followed through and someone just didn't follow through and do what they needed to do. Or they would have a receipt or documentation proving that it has been reduced to a parking tickets.

Unknown Speaker 3:01
And the reason why you want to get speeding ticket off your record because it does affect your your auto insurance policy when it renews when your auto insurance policy renews the insurance companies, auto insurance companies will run your driving history. And they also will also check on the household summary of all the licensed drivers in the household. I know some of you probably experience drivers added on to your auto insurance policy and you get very upset because the rates go up. Now this individual living in your household may have their own auto insurance, they are allowed to drive their your vehicle with their own auto insurance. And you allowed to drive their vehicle with their own with their with Joe auto insurance. So when a person is added on to your policy, you can get them removed by simply showing proof of insurance with the company that person has for their car insurance. But if you get a DUI, you know, this is where Christine comes in to help you due to that train wreck process because it is going to

Unknown Speaker 4:00
be hopefully we can keep it from becoming a train wreck.

Unknown Speaker 4:03
Okay, okay. And you know, just a few steps on a person who gets a DUI, should they cooperate with the police officer and take says on site or should they just just say, You know what, I'm not taking a test. I'm just gonna go just give me a ticket. I was always confused about that.

Unknown Speaker 4:17
I think that depends on the individual. If you know you're right, okay, you know, you have not been drinking, then what's the problem?

Unknown Speaker 4:25
Well, if you have been drinking and the case, if you have been drinking and you pulled over by an officer, and you have been drinking, so you're going to jail either way, right?

Unknown Speaker 4:33
I don't think you I don't think you should be forced. I think you have rights, okay, that you need to

Unknown Speaker 4:38
uphold. Okay, I understand that and that's a good, that's a good way to answer that because every situation is unique and different. What I know is customers. My customers have come to me with DUIs. And they've experienced the insurance companies, other insurance companies, not the one I represent will either cancel a policy or non renew them, or the rates are just very expensive. So now we're in the process, when you do receive a DUI, you have to keep in mind that your license may get suspended. For a while, you may have to carry an sr 22, or certificate of financial responsibility. But you know, this is this, this is a step by step process when you receive a DUI, and if you receive one DUI, be very careful out there. Because once you have one DUI and a police officer is driving behind you, they run your plate number and they see if you've already received one DUI, more than likely, you will get pulled over for Spacek.

Unknown Speaker 5:34
Yeah, so if they if they are pulled over for spa chat, or get any type of ticket, give us a call, so that we can put you in touch with the right person to handle it correctly. Well, why don't you give me your contact information I can be reached at 702-430-2240. That's 702-430-2240.

Unknown Speaker 5:59
Along with your services, you also offer right of survivorship, on a home on home deed, the deed now that's very important because, you know, you can experience losing a spouse, and then the right of Survivor on the deed would inherit the property in most cases, without without having to have them go into probate. But without this information on your deed, and you're the only surviving spouse, who you're gonna leave your home to, you don't want you work hard all your life to purchase your home. But you didn't, you don't have a will you don't have a trust. But you do have an opportunity to put a person on the hold, as is in position as a beneficiary. As a writer, survivor, or in lieu of death. When that day comes in, it comes for all of us, and the home is passed on with it without a mortgage to the next person seamlessly without having hopefully without having to go through probate court.

Unknown Speaker 6:56
Yes, there's a lot of those situations that we can add, for instance, your children, or a relative to the policy to your to your deed, it's called joint tenant Right of Survivorship. The issue there is you have to prove that this is a relative, that they are part of your family, they usually ask for a birth certificate or some type of acknowledgement that this is a family member, whatever, you have the same last names, you still have to prove it, you still have to prove it. Yes. And the reason for that is if it's just a couple living together, that's not considered a relative. So it's $1,400. If you're adding someone that's not a relative, it's $45, if you're adding

Unknown Speaker 7:46
up to $45, or up to $1,400. And the reason why you want to add a person in position, right a survivor is because it does transfer over to that individual. And the and these fees are, you know, minimal in comparison to try to come out of probate seven years later down the road, if you can afford to get the home because now all the court fees are added on absolutely added on. And then you say to yourself, I can't afford the hug.

Unknown Speaker 8:13
And what I've done, you don't have a family member or you don't have anyone or relative to leave the home to. Sometimes people want to leave it to a charity or TOS to just a nephew or a relative, another relative that could be distance, there's a document called deed upon death, that will also lead that property to that person, you fill out the document right now, you decide who you want the home to go to, or what charity or organization at church, and upon your death. That company, that person takes the deed to the recorders office, and the deed is transferred to them.

Unknown Speaker 8:51
Now I don't recommend people putting young children on life insurance policy as a beneficiary. I've had people come to me and say, Well, I want to add my three year old on as a beneficiary, that that holds true to putting the person in lieu of death, you wouldn't want to put an infant or a young child, you want to put an adult

Unknown Speaker 9:11
guardian, if you a guardian would have to be appointed. If there is a child, people can do it. But there needs to be an adult appointed legally as a guardian to do that.

Unknown Speaker 9:23
There's a lot of moving parts along with this. But you know, in order to do it the right way, you can contact Christine and she'll help you step by step it because it's really not that complicated. It's just a matter of to do it just said, you know, it's winning 23 Let's get our houses in order, right. It's the first of the year and a lot of times, you know, we kick the can along and say I'll do it next month. I'll do it next week. But next week, next month, never

Unknown Speaker 9:48
haven't come and along those lines Stein, I'd like our listeners to think about those who are have children, mothers and fathers who have children who do not have a will. If something happens to you, who gets the children, you have to appoint a person in your will both the mother and the father that need to that would get that child otherwise, the court gets to decide where your children go. And that could be someone that you completely don't want to have your children or your children would would not be in the best of hands. But the judge is not going to know that. So the best thing to do is to draft a will and appoint someone to care for your kids.

Unknown Speaker 10:31
Along with that I want to personnel and you've been very helpful with me, thank you very much Misty with getting power of attorney for my clients. And that really that holds true to people with Alzheimer's disease, dementia, organic brain syndrome or ALS. Now these individuals when it comes to purchasing life insurance, they cannot speak in their behalf and also people with dementia, Alzheimer's, cannot pay for the life insurance policy themselves. With a power of attorney. You can be the power of attorney for that person, you can answer the health questions and also sign for that individual as power of attorney to get them a life insurance policy. My name is Don Marquez, if you're just tuning in, this is your insurance connection we broadcast right here at K you in the 91.5 Jazz and more and more Sunday mornings, from 8am to 830. A life insurance policy for a loved one that has Alzheimer's, dementia or organic brain syndrome loans known as Lou Gehrig's disease, ALS is don't give up, you can get them a life insurance policy. My contact phone number is 702-236-2624 702-236-2624. My name is Donna Marquez, this is your insurance connection. I'm a licensed insurance broker right here in our beautiful city, Las Vegas, Nevada. My Location is on the corner of Sahara Rancho, in the US Bank Center, located on the eighth floor, thank you so much. I mean, because it's been many times when I've had clients that needed that power of attorney, not only for the individual with Alzheimer's or dementia, but what about if you have young family members, that the industry's doing their thing? And you want some type of protection on them? Yes, oh, a power of attorney is a great tool to have. For that reason alone. If you have a loved one that's kind of wiling out to industry on drug alcohol abuse, you can get a life insurance policy on them, you answer all the health questions, they don't even have to know they have a life insurance policy as long as or if you don't have it, we need the social security number

Unknown Speaker 12:41
date of birth. Yes. And we need them to sign the power of attorney, that an

Unknown Speaker 12:46
individual, that individual is out there doing anything? Yes. Okay. So I did that I did not know. And that's good to know. But I know for a fact you don't, they don't have to sign the life insurance. Now with the power of attorney in place. They don't have to sign a life insurance policy, because the individual that is power of attorney on that person over that person is now the owner of the life insurance policy. They are also the beneficiary and the other payer. Now, that being said, the person to the applicant that we write the policy on, they cannot borrow money against the life insurance policy, because the policy does accumulate a cash asset. So that protects you from because you're paying on a policy because you've been you've been assured a loved one out there, or a loved one that has Alzheimer's or dementia. They cannot call the insurance companies up and make any changes on the policy, because now you are the owner of the life insurance policy. Now when it also comes to life insurance, when a person has to go, and I've brought this conversation up to you before, if a loved one has a life insurance policy, and they may have to go to a nursing home, what should they do prior to going into a nursing home to get their paperwork in order?

Unknown Speaker 13:59
Well, first of all, they need to contact an attorney because if they own any kind of assets, we need to take care of those assets prior to going into a nursing home. They need to be signed over. Someone needs to take over the home. Someone needs to take over the bank account because the nursing home will most likely collect the benefits.

Unknown Speaker 14:22
And is this a normal procedure for nursing homes to collect your assets that you have to cover the cost of taking care of you while you

Unknown Speaker 14:34
sometimes it's a backup because if you have insurance, the insurance may not cover the total amount. So the assets are the backup. So it's best that we look at the assets prior to if you know that someone is going that direction. Let's get that taken care of prior

Unknown Speaker 14:52
to going into a nurse correct because you know loved ones. There it come to a point where you cannot take care of your loved ones anymore you need professional Oh yes, you can't take care of my house and you shouldn't, you know quickly is a tough decision to make to put a loved one in the nursing home, but it's for the best care. However, it is some steps that we need to take prior to prior to putting your loved one in the nursing home. My name is Dawn Marquez, this is your insurance connection along with Christine Banagher. Thank you so much for joining me, thank

Unknown Speaker 15:21
you for having me.

Unknown Speaker 15:23
Anytime, you know, we, we do this, you know I, it helps people better understand what to do. And these different types of situation. This is an educational program. I'm a licensed insurance broker and you also have license apparently go paralegal to help you and to help you through the process. Our auto insurance, homeowners Yes, and life insurance. final expense life insurance, if you have a loved one that has been turned down for life insurance, don't give up we can get them a life insurance policy. If you have a loved one with lupus, a history of diabetes, or even a history of cancer, heart disease, kidney disease, liver disease, and have over 12 months to live. Because I've had people call me and my dad only has three months Leo, can we get him $100,000 life insurance policy, you know, that's not going to happen. But if you if you have loved ones been turned down or you've been turned down for life insurance, don't give up. My name is Don Marquez. My contact number is 702-236-2624 702-236-2624. It is the first city at 2023. And I was I was I was talking about this just the other day back in 1975. Christine, did you ever think about what you're going to be doing it? 2023?

Unknown Speaker 16:42
Who could ever think about 2020 is just like 10 years from now? Right? What is 2032? Gonna look like? Back

Unknown Speaker 16:50
in 1975? And you can remember 75 Right? Yes. What are you thinking about? 20? Yeah, well, we'll be doing and 2023 The End Time goes by quickly. 1975 didn't seem like that long ago. No, it wasn't what we already know. Even the 90s didn't seem like that long ago. But when you when you pro postpone things you need to do like taking getting a life insurance policy, finding a life insurance policy that you can afford for that peace of mind for that one day, when it comes when it comes for all of us. Your family is now struggling. They're not in a financial bind. You're not passing on generational debt, you're passing on generational wealth, generational security, knowing that your family members not is not going to pay for a very expensive funeral up to 15 $20,000 today in today's prices, and also not only that, you other Hey, you have other final expenses, you may have to move their furniture out of the house, pay a car payment, pay the car insurance, the utility bills, the keep the markets going keep the mortgage going, maybe you have to pay rent for a couple of months, take a time word fly into another city, these are found expenses you do have to pay. And if your family member doesn't have a will or trust, you know, the nightmare continues. Absolutely. And by getting a world of trust, moreso a trust and a will because a will can be contested, right?

Unknown Speaker 18:11
A welcome to get a will can be contested. But what a will basically does is it takes care of your your things, your property, the things within your home, the things that are not in your trust, the trust handles your financial, your businesses, your home and things of that nature.

Unknown Speaker 18:29
So if a person doesn't have a business, can they still get a trust? Absolutely, yeah, and you have a trustee to secure, the person is going to be over the trust. emanate

Unknown Speaker 18:40
someone that you trust, or their companies that can be a trustee for you.

Unknown Speaker 18:46
Now when you are when you have a trust, let's say you have a trust in place, and you do have to go to a nursing home. Is there any further actions you need to do if everything's within the trust? I

Unknown Speaker 18:56
don't think so. But that could be something that comes up at the last minute if someone goes to a nursing home, which is not in the trust, so it would just depend on how sick that person

Unknown Speaker 19:07
can't now can the nursing home take over your trust that's protected, that's protected and homesteading? What is what is that? That's

Unknown Speaker 19:15
when you purchase a home generally you homestead the house to make sure that if you're sued, your house cannot be taken away from you for mechanical, mechanical liens or medical lien or medical liens as well as well. I think the only thing that it doesn't cover is the IRS. Oh, we're not

Unknown Speaker 19:36
we're not going to mention the Internal Revenue Service because you know, tax times coming up. Make sure you pay your taxes that's all I have to say, file your taxes and you know pay your taxes and if you get a refund God bless. I haven't seen a refund a long time. Was that? Yeah, it was a refund. But you know, these are steps you need to take step by step. If you have life insurance policy. And I've said this many times on the show, and you lose your primary beneficiary and you don't have a contingent beneficiary, you need to contact your life insurance company and ask request for a change of beneficiary form. This is very important paperwork to have, because to my understanding if you go into a funeral home, but there's no primary beneficiaries, there's no contingent beneficiary. And let's say you're next to Kin, your son or daughter, and your dad passed away. And he's the only the Europeans are gone, Buffy parents are gone. But there's the wife was the primary beneficiary she passed away before the husband. There's no beneficiary, that policy could go into probate. Absolutely. That policy who's going to probate and you need the money right now? Yeah, to bury

Unknown Speaker 20:49
a loved one, it may take probate now, minimum is a year or

Unknown Speaker 20:53
you minimum a year. Yeah. And you need the money now to bury your loved one. And you're the funeral home cannot pull monies out from that life insurance policy to take care of that one of the one of the final major final expenses you have to take care of right away. But this is why we have this talk show at K u and v 91.5. Jazz and more Sunday mornings from 8am. To 830. To better understand the process, step by step you need to take to keep your house in order is 2023. Now it's time to get your house in order. If you've been kicking the can for quite some time. And I and I talk to people they say well, you know, I've had your number in my phone for the last three years. And as you know, I keep getting this guy on the radio every week and he goes great information, I need to contact him. And but as long as you contact me, but I'll continue to procrastinate. That's not a good idea. Because if you're looking to purchase life insurance belong, you cannot procrastinate. The older you get, the more the policy's gonna cost when you get it, things change,

Unknown Speaker 21:53
and people change. Like you said, someone may have passed the same thing with a power of attorneys, you need an alternate and those powers of attorney or they won't be good either anymore, in case you need to use them for your life insurance, you need to keep those two up to date

Unknown Speaker 22:09
with the power of attorney. Is it? Is it is it valid in other states. So if you take out of a power of attorney have on a loved one here and by the end that loved one moves to another state, and you are

Unknown Speaker 22:21
the power of attorney as long as it's notarized. It's a legal document. It's

Unknown Speaker 22:25
a legal document regardless where they live. Yes, correct. My name is Don Marquez, my contact number is 70223626247022362624 Having a chitchat with Christine, we're now the one and only to help you go through this, you know, this is not that difficult. No, this is time taken. Just think about if you watch television for two hours, you can get this done in less time. Absolutely. If you if you can sit down and watch program if you if you watch a lot of television, okay, you watch a couple of shows. You spend three or four hours on televisions daily, right? People on average, spend at least three to four hours watching television daily.

Unknown Speaker 23:09
And how long does it take to call you and get this process going? Not long

Unknown Speaker 23:13
ago, not alone most life insurance policy I can I can complete within 30 minutes. Yeah,

Unknown Speaker 23:18
same with oil. If someone I sent him an email with a list of questions, they reply to the email, I can turn their well around within 48 hours. final

Unknown Speaker 23:28
expense life insurance is not that difficult, we can get you a final expense life insurance up to $35,000. In coverage. There is no health examination to apply is only just a few health questions. Sometimes you don't have time to grieve because the loss of a loved one. And then you find out you're you know and here's another one with the power of attorney. Does that help the individual when the when your loved one passes away? Well,

Unknown Speaker 24:49
yes, because you have the ability to be able to handle their Social Security, hire an attorney, do all the things you can

Unknown Speaker 24:56
and the person has passed away. Yeah. Okay. So the power of attorney To my understanding the power of attorney ceases when a person passes

Unknown Speaker 25:03
a medical power of attorney ceases. Okay. When you pass away financial, you need to be able to close a bank account and finalize all of the things when

Unknown Speaker 25:14
a person has a power of attorney. But they're not on the bank accounts can they use the power of attorney along with the death certificate on the institution depends on the institutions and this is why it's so important to listen to this program. And then not only listen, but take action, get Christina call and your number is

Unknown Speaker 25:30

All when I when I pass away. I will leave my home to my

Unknown Speaker 27:35
children, but you never put it in writing. You never put it in writing.

Unknown Speaker 27:39
