Good morning. This is your insurance connection. I'm your host, Donald Marquez, on your insurance connection. We talk about saving money on auto insurance, homeowners insurance. Yes. And we talk about life insurance. Welcome to the show.
Unknown Speaker 0:40
Good morning. Good morning, Las Vegas, Summerlin, Henderson and all the surrounding communities. This is Donald Marquez with your insurance connection broadcasting from K u and v 91.5. Jazz and more. With me today I have a special guest. Her name is Christine Barnard. Good morning, Christine.
Unknown Speaker 0:58
Good morning, everyone.
Unknown Speaker 1:00
I'm happy for you to be here. Today, we're gonna talk to our listeners about what you do as a paralegal, a notary. And of course, we always go talk about insurance on your insurance connection. But I thought it was very important for our listeners to hear about your services expressly. You know, when it comes to getting a speeding ticket in the state of Nevada, we can get that reduced down to a parking ticket. However, you know, some of our listeners that are listening to us right now, they probably have been to court and the judge have told them or the processor have told him in court that we will reduce down to a parking ticket. However, as an insurance professional, when we run the driving history, we see the speeding ticket, although they go to court is it well, they told us it will be reduced down to a parking ticket, what what is the breakdown? What happens and we see the speeding ticket and they don't take it off. Like they said they would in the courts?
Unknown Speaker 1:52
Well, a lot of times you go to court, they will reduce it. But it still shows up on your record as points. I suggest anyone who has a ticket to contact someone like myself, so that I can put you in touch with someone to make sure that we don't have this on your record, we can get it cleaned up before it even gets to court, we can have it reduced. And we negotiate with the court so that it is not on your record,
Unknown Speaker 2:20
I see that after they pay the ticket, you still can have a reduced Anthro Park and
Unknown Speaker 2:25
they need to contact us prior to as soon as you get that ticket, you need to make a phone call to me marker. And then I won't put you in touch with the person that handles tickets
Unknown Speaker 2:35
because it's important. It's important information. And the reason why is this when you have a speeding ticket on your driver's license, it will affect your insurance rates. People are concerned about the insurance rates in the state of Nevada, what can I do to keep my rates down, this is a procedure you can do. And it's cost effective to do it. Because once you get a speeding ticket, it'll stay on your driving record for five years. So you're going to be rated on the insurance for five years. So you're going to be up rate it on your auto insurance policy for the next five years. Now, it does reduce down a little bit. But if you let's say you get a couple of speeding tickets within five years, you know, that could be very expensive, if you don't go through, like yourself, but if you don't go through Christine Barnard and her phone number is 702-430-2240. Again, her office number is 702-430-2214. She is a paralegal and once you tell us the rest of your services that you offer and provide,
Unknown Speaker 3:38
we offer wills, power of attorneys and there's several different types of power of attorneys. There's a medical power of attorney, which allows someone to act in your behalf in case something happens to you or you are unable to speak for yourself. There is a financial power of attorney which, for instance, if you get sick and you're in a nursing home or something like that, you someone needs to have your power of attorney so that all of your assets won't go to the wrong person, or the nursing home can't take them away from you, or upon your demise when you're gone. They have the capability of handling your estate, taking care of everything for you.
Unknown Speaker 4:26
And the reason why this is very important because you and I have done business in the past where I offer a life insurance policy. However a person may have dementia, you know, and they can't speak for themselves. So they cannot be the owner of a life insurance policy. They need to own it with ownership of life insurance policy, they have access to the life insurance policy. They can make changes address changes, they can change the beneficiary, they can change the payer or they can be them, the beneficiary, the payer, and the owner themselves. With the POA a power of attorney financial appeal a financial appeal. Because we went, we went back and forth a little bit until we got until we finally got the right POA to the underwriter to satisfy their requirements, what I've learned a valuable lesson with that, because I do have clients that contact me with family members that have challenges, mental health challenges, and that the fact that you're still gonna get a life insurance policy, even if a person have mental health challenges, but they need a person over authority and a power of attorney does that.
Unknown Speaker 5:29
Yeah, it's called a principle in fact, and that's what the financial power of attorney does. So I offered that service to prepare prepare those documents, offer the medical power of attorney along with the last will and living trusts. We tried to also add someone to a deed. For instance, if you have a home, everyone who has a home, that is on the deed by themselves, needs to add someone to the deed to keep it out of probate. It's called a survivor, the right of survivorship. If you have a right of survivorship, the person that is on the deed with you can continue to pay the mortgage, if there is one, they can handle whatever issues there are with the home. And eventually, they can have your name removed once your deceased with a death certificate, proving that it's it's now their home because they were on the deed as well.
Unknown Speaker 6:32
I'm glad you mentioned that because when my mother in law passed away, and then of course, my wife preceded her passing away years, four years ago. Now when I was on as right of Survivor, yes, my wife and I, now her name, my mother in law name was on the mortgage. However, when I contacted the mortgage company, my wife was deceased, my mother in law's deceased now I'm the only one that's on the on the deed as right of survivor, and my name is not on the mortgage. However, the mortgage company would not communicate with me how, what what I needed, then in place to be able to communicate with the mortgage company,
Unknown Speaker 7:11
while one of them were still alive, your name needed to have been added to the mortgage, as what, as right of Survivor
Unknown Speaker 7:20
as right as a variable on the mortgage on the mortgage, you can do that as well,
Unknown Speaker 7:23
as well. Oh, I didn't know that. That's the best way to go. That does not say that the person who you're adding has the ability to take out a loan. Right or to mortgage your house. Okay. It's right of survivorship from the principal person I see. So I suggest to people who still own have a mortgage, add that person as the beneficiary, as long as your name is on the mortgage in some form or fashion, they will have a conversation with you.
Unknown Speaker 7:52
That doesn't mean a person has to have their credit ran or anything like that. It's just a beneficiary position. Yes. For the principal person. Yeah. Now as a beneficiary as your name on a mortgage as right, a survivor, can you still speak on behalf of the individual, or they would need their permission if you have that power of attorney? If you have the power of attorney while they're living?
Unknown Speaker 8:13
Yes. Okay. Because what you can do is the the owner can prove this person. Um, I'm signing saying that this person can speak on my behalf person, and it's you have documented to notarize, which something that I do to prove that you have the ability to speak as well.
Unknown Speaker 8:32
And it's all speaking as well as signing for the individual as well right. With the POA you can also sign for the individual
Unknown Speaker 8:40
you can sign in place of the individual RC. Yes,
Unknown Speaker 8:43
this is very important information. My name is Don Marquez, this is your insurance connection. We're here today, Sunday morning, early Sunday morning, get you a cup of coffee and turn us up here with Christine Banagher. She is a paralegal. She has been one of my go to team members on your insurance connection. I have clients coming in with concerns and I refer business to her regularly. We communicate at least once a week. And you know if you have a home and you need to add someone on a deed if you're the only survivor now if you have a husband and wife situation it's always good to add someone on as right of Survivor again, they can't sell your home or or mortgage your home as right as survivor, you place in a beneficiary position if I understand you correctly, and also we talked earlier if you're just tuning in, we talked about reducing the speeding ticket down to a parking ticket wherever you would have to contact Christine, before you go to the courts at 702-430-2240. Again, her number is 702-430-2240. Not only that, does Christine offer pol A's and getting parking tickets reduced down to many speeding tickets reduced down to a parking ticket. Do you also offer notary services?
Unknown Speaker 10:03
I'm a mobile notary. There have been some instances where people have been sick and unable to get out and come meet with me. I have been tested, I am negative, I do wear my mask, but I will. I will oblige and go and, and notarize documents for people who can't get out and get to a bank or get to a notary service.
Unknown Speaker 10:29
Well, that's very important information. Again, this is Don Marquez, that's your insurance connection. My number is 702-236-2624. I'm a licensed insurance broker. We've been broadcasting here at Kadena the 91.5. A little over a year now. And you know, I want to thank the people that have contacted me the purchase home, auto and life insurance. I in my office, I tried to extend services that I don't provide, that my clients need, they need wills, they need to trust, you know, they need a go to person when they get a speeding ticket. Now let's take for instance, if a person this came up yesterday, if a person has a DUI, right, the person has to do that's a very expensive lesson, isn't it? It's very expensive. So when a person has to do Yeah, what would the first thing they should do was after they get arrested,
Unknown Speaker 11:16
they need to call an attorney. Because they need to be represented. Because that will stay on their record, the attorney at that point, can also negotiate how that is dropped down. It doesn't necessarily have to go as a DUI. So if they reach out to me, I have attorneys that I work with that can handle that situation. Because you don't want more than one or two of those, you get your license suspended and you don't get it back.
Unknown Speaker 11:45
Once a person gets a DUI, how long does it stay on your driving record? I think it's five years, five years. And now our to my understanding California a little different, I think they can reduce it down to make it disappear altogether. Once a person is continue the classes or whatever they have to do,
Unknown Speaker 12:04
Nevada has the same practice. But you have to go through an attorney, you have
Unknown Speaker 12:08
to go to an attorney, yes, but they can't reduce yourself, you can't reduce it before the five years are within that five within that five years, it can be reduced down to
Unknown Speaker 12:16
what it can be reduced to a parking ticket or a misdemeanor or misdemeanor or something like that.
Unknown Speaker 12:22
Once a person listens once a person gets a DUI, and they're like shopping for car insurance, because sometimes the car insurance companies will drop that person once they get a DUI, they will say no, thank you. But as long as you you've been with us, I know you've been with us for a very long time. But you know,
Unknown Speaker 12:39
thank you. If they have an accident or something, they'll generally pay the claim. Once that claim, then they have let you go
Unknown Speaker 12:47
right when a policy renews this is when you get your renewal renewal notice that we're not going to non renew you because of the DUI because of the DUI and this happens quite often. By the way, I'm an insurance broker, I can do the shopping for you if this has happened to you. We can shop you for another insurance company. I represent multiple auto insurance companies, we can find a company for you. Again, this is valuable information again, this is Christine Barnard as she If you're just tuning in, her contact number is 702-430-2214. She is a notary. Paralegal, too. And she helps with demand letters. What is a demand letter, a demand letter
Unknown Speaker 13:28
is if you owe a debt, and someone sends you a demand and they say you have 30 days in which to pay this debt. That's the demand letter. Also, if you are a landlord and you have a tenant, and you're trying to get rid of the tenant, we can provide a demand letter to the tenant, giving them notice that this is your this is your 30 day notice or this is your 60 day notice to vacate. Well, fortunately goes to a
Unknown Speaker 13:57
right fortunately Vegas, we don't have we have we have a luxury the courts say they own it right away. I am a landlord. And I've had to evict people, I don't like doing that. But you know, it costs money. I can't afford to pay the mortgage, and personal live in my home for free. I can't you know, you can't stress it. And I know in California, you know, they can squat on you for quite some time before he gets to the courts. But in the state of Nevada, you can evict a person within 30 to 60 days easily in the state of Nevada would know whether you in Las Vegas or Henderson, or now or North Las Vegas as a landlord have
Unknown Speaker 14:31
to go through the process. Yes, you do have the paperwork and I'm just saying I can assist with that as well.
Unknown Speaker 14:37
What I what I've done in the past, you can help me with this. To notify a tenant on the five day notice. I would go to the courts and pay for the cost but it'll show up using what I've used to do my own five day notices, but they would just look at my five day notice. Oh by the way, they didn't take it serious. And I'm like okay, they didn't respond to my five day notice. But I learned quickly. Once I sent the constable out there. They took a very serious Yeah, because a constable bangs on the door and we you know has a uniform on and oh, it's embarrassing and they put a notice you have five days to vacate to pay rent or something. I mean, it's embarrassing then I get a phone call right away. But once a constable shows up then they know I'm serious. My name is Donnell Marquez, I hope this is valuable information for you. And it certainly is for me. I've learned a lot in the short time we have been talking and Christina. Now we've worked together closely. We're a little over a year now I believe and I don't remember how we met. I really don't. I came in to buy a life insurance policy. Yes, yes. Right. That's right, you do final expense policy final expense life insurance policy, we do offer final expense life insurance policies. And through that we've connected to trade off business with each other. And it's been a while we've been both valuable assets to each other. And from time to time, Christine will be on the air. Talking to you about your concerns when it comes to protecting your, you know, your auto insurance policy. This is auto insurance policy protection. Because if you do get a DUI or a speeding ticket, don't feel like you're alone out there don't know what to do. Because there are resources out there to help you. Again, Christine's contact number is 702-430-2240. Again, 702-430-2214. Bargain of grant bargain sale D what is that
Unknown Speaker 16:32
that is the D that we add the Right of Survivorship to Okay, that's what it's called. quitclaim deed. For instance, if you create an LLC, and you buy a property, you want to sometimes put that property in the LLC name. I can create an LLC within 24 hours for you, we get an EIN, from the IRS, and a lot of people are trying to start their own businesses right now. An LLC is an easy way to start a business where you can add DBAs into the business as well.
Unknown Speaker 17:07
Answer to complaints respond to discovery for litigation. What is that?
Unknown Speaker 17:14
For instance, if you're on a par, you're in a car accident, you generally go to an attorney, they give you a bunch of papers, they asked you a lot of questions. They're called interrogatory, and discovery. You have to have those documents returned to the attorney within 30 days, or the lawsuit is filed with the court. I can help you answer those questions. I know the terminology I know what they're looking for. I can help you gather the information and the details to respond to those complaints. Interesting, very interesting. And not just personal injury, it could be family law matters. It could be estate matters. But it's called discovery.
Unknown Speaker 17:54
When a person gets a DUI or in a car accident sometimes you know they run against an attorney especially when they get in the car accident right? They get an attorney and that's fine too they have not an option to contact an insurance agent expressly if they're not at fault. If you if you've been in a car accident and you know if if you haven't been checked out you should get checked out by a doctor to make sure you're okay sometimes the in these written collisions people are injured and don't even realize they're injured and they may not feel the pain right away. They may feel the pain a few days later and or in a car accident if you're seriously injured you need to go to the parent and get a call a paramedic have them come pick you up take you to the hospital. A lot of people I was worried about the cars. Now here this is what I found out when they when they impound your vehicle if there is a fee, right? So daily, yes to my understanding what I did I was in a car accident a year ago and it was my fault unfortunately, it was my fault. But instead of having the impound come pick up my car. I call a tow service to come pick up my car I'm a membership on my tow membership to pick up my car and take it to the dealership. Because the my understanding that you know when you want your car goes into your impound, they trash it pretty much and they don't care and it costs you money every single
Unknown Speaker 19:14
day those fees add up. It's a lot of money to get your car out and the impact it is
Unknown Speaker 19:18
whether it's your fault or not. Right right and the insurance company may or may not pay for that. And that's what people don't understand. If you have a motor club or if you have roadside service on your vehicle car insurance, you can contact you know right away contact them right away and tell a police officer you have your own tow vehicle coming to pick up your vehicle just in case it's your house. So yeah, anywhere you want to take it to like because people quickly find out when he when he goes to the impound oh my god the car was Did they have the car in the impound services? They don't care they'll pick it up and you know do cause more damage to your vehicle. If you're just tuning in, my name is Don Marquez. I'm here with Christine Barnard my contact number is 702 1236 2624 702-236-2624 I'm a licensed insurance broker at your insurance connection for homeowners, auto, life insurance, motorcycle and boat insurance. I've been licensed insurance agent since 1996. And again, we broadcast right here K, u and v 91.5. Jazz and more Sunday morning from 8am to 830. And I just hope everybody starts 2022 off taking care of their financial responsibilities. If you need a life insurance policy, just like Christine said earlier, the way we met is through her coming in to my office and purchasing a final expense life insurance policy to take care of those final expenses. People think just because I've taken care of, you know, I pay for my burial. And that's it. Right. But there are other expenses closing out one let's date time. Let's talk about that a little bit. Yes,
Unknown Speaker 20:57
I think I think what you also need to do is talk have someone designated that you want to handle your estate for you, someone that you can lead that policy with, or you can tell them where that policy is, so that when the time comes, they can pick up the phone and call that person, right. They can call that. Is it Lincoln heritage?
Unknown Speaker 21:20
Or use various companies like inheritance? I mean, it just depends on the company that I put the person with. Yeah, I represent 67 Life insurance companies. So it's, I know, it's a lot of companies that I place people with now, everybody's not the same. You can be identical twins, but your health could be a different from your identical twin. And if you don't qualify for the larger policies, there's always an alternative with the final expense life insurance policies up to $35,000. In coverage, there is no physical, you know, 11 questions, yes or no questions? Easy qualification. It was seamless, right? It was very easy, very easy. You can pick the due date between the first and the 28th of each month when you want to make your payment. And you can always pick up the phone and contact direct the insurance company and make any changes. Now what you said earlier in the conversation would tell your beneficiary number one, they are the beneficiary. Yes, right. And number two, tell them Are you valuable paperwork is Yes, tell me how important it is.
Unknown Speaker 22:20
Let me just say that all of my clients, I suggest that they buy a fireproof safe, we can't. When the time is when the time has come, go looking all over the house for all of your documents, we need to know where your where your deed is, we need to know where the life insurance policy is. We need to know where your deaths, your birth certificates, your social security card, those type of documents, it's really helpful if everything is in one place, and the
Unknown Speaker 22:49
marriage license, right and the marriage license and the marriage license. Now, only the beneficiary can represent the deceased person. Ya know, I've had people contact me, they don't know what a life insurance policy is, they are tearing the house up looking for it. Because they know they have to, they don't have time to grieve, because they have to go into business mode. Business mode immediately. Because Oh, first of all, you lost a significant loved one right? Now you like huh, then you know that now it's time to go to work? Where is it? Oh, is everything that I know they had life insurance? Can you tell me and I have people calling me and telling me asking me do they want me to tell them? You know, my loved one died? Now they didn't have any life insurance with me, right? My loved one died? And how can we find out whether this person have life insurance and that there is no network out there that I can go on my computer and tell them and especially if they haven't purchased any life insurance through me, the only way I tell them is look at the person's bank statement. And now if there's an automatic deduction, money coming out of the account, each month, you'll see wherever company life insurance being deducted, you can contact that company direct only, only the beneficiary but the problem is sometimes people don't know they are the beneficiary
Unknown Speaker 24:05
or exactly they haven't had that conversation with that person to say I've made you the beneficiary on this account, or even employers, you or their employers generally offer a life insurance policy, whether it be small or not. They usually always designate a beneficiary. You need to tell the beneficiary that they are the beneficiary on that policy, so that they know I can call this company I can call this company, this is where it is and also on bank accounts. I suggest that there be a beneficiary on the bank account. That doesn't mean that that person can go take out all of your money, great, but when your time is over and they have a death certificate, they are in charge of your assets. They can take care of it.
Unknown Speaker 24:54
What I see is also consistent is it let's say you lose a spouse. Yes. And you and your spouse AAS was your primary beneficiary, and there's no contingent beneficiary. Now, years go by, right years go by now that primary passes away, right? And it's done. Now they have to go through a lot of legal matters, they have to show proof of kinship. It's a mess. It truly is. Now, although your spouse passed away, and there was a primary beneficiary, it is not the life insurance responsible life insurance company responsibility, that contact the person that's still living, because they don't have a beneficiary to say, Yeah, we need to update your life insurance, they're busy, they don't have time to do that. So if you only have one primary beneficiary without a contingent beneficiary, and you lose that beneficiary and don't add another beneficiary, you know, you put your family members in, they're gonna be all confused. They don't know what to do. You know, it's, it's hard to lose a loved one. Now you have to grieve, and you only grieve slightly because it's so much business to take care of right away, you have to take care of the final expenses at the at the funeral home, they're in business to make money, and they make a lot of money. And they charge a lot of money for their services. And the thing about their services, they want the money right now, it's not like, well, we'll take payments for the next 20 years, but they want the money. Now, this isn't what a life insurance policy would do for you. It'll take care of that final expenses, and other expenses, you will have to close out a person's estate. That could be credit cards, if you're a joint member on a credit card, that credit card man that may or may not go away. One of the leading causes of bankruptcy is because losing a significant person in the household and income earner, now they leave in a family with no money. And all of a sudden, now they have to survive the mortgage and the rent is still coming in. The cable bill is still coming in to power this, the car insurance is coming in to homeowners and the renters. And I mean, it's just and you have to eat. And sometimes when you lose a significant loved one, you lose that income or that income can be reduced down to 50% or less is very important. I mean, this information that we give you right here, k, u and v 91.5. Jazz and more. It's educational, because people they contact me and they say thank you so much for the information you provide. I mean, because they don't know they really don't know they may have good intentions, like we were talking about earlier to leave their home to their children. I have good intention, no one was going to go to my child. But if you if you don't have rights of survivorship, and if
Unknown Speaker 27:27
it's not in writing, right course, parents will generally say I'm leaving this for your children. But if you don't have it on paper, the children aren't going to get it. No, no needs to be documented. It needs to be notarized. And also what people don't realize is if you do have a will, within 30 minutes or 30 days, you have to file that will with a court to avoid probate. So to begin, you have to file a will within 30 days of death to avoid probate.
Unknown Speaker 27:58
Now if a person is on right of survivorship there's no it's not necessarily any court right
Unknown Speaker 28:03
there's no court but you still need to file the will that gives you authorization continued authorization to continue that person's responsibilities.
Unknown Speaker 28:12
